Expert Witnesses

  • A witness who is qualified as an expert may testify in the from of an opinion if:
    • their specialized knowledge will help understand evidence or determine a fact;
    • their opinion is based on sufficient facts;
    • their testimony is based on reliable methods; and
    • the expert has reasonably applied the methods to the facts of the case.

Competent Representation

  • A lawyer shall provide competent representation to a client.
  • Competent representation requires the legal knowledge, skill, thoroughness, and preparation reasonably necessary for the representation.

Pro Hac Vice Admission

  • Pro hac vice describes the process for adding an attorney to a case in a jurisdiction in which they are not licensed to practice to prevent the unauthorized practice of law.
  • Usually, attorneys who practice pro hac vice must do so with local counsel.
  • Pro hac vice serves the interest of local courts to ensure that attorneys who practice before them are qualified to both advise their clients on local laws and comply with local rules of practice and custom.

Cross Examination

  • Cross-examination provides opposing counsel an opportunity to point out weaknesses in a witness’s testimony, but
  • Should not go beyond the subject matter of direct examination and matters affecting the witness’s credibility.
